Indigo Estates (Jersey) (2013) Limited, trading as Indigo Estates, referred to as "Indigo Estates" ("we") or ("our"), is committed to protecting the privacy and security of your personal information.

This Privacy Notice describes how we collect and use personal information about you during and after your relationship with us, pursuant to the Data Protection (Jersey) Law 2018 ("DPJL").

Indigo Estates is a "Data Controller," which means we are responsible for deciding how we hold and use personal information.

We are required under data protection legislation to notify you of the information contained in this Privacy Notice.

Indigo Estates (Jersey) (2013) Limited, referred to as "Indigo Estates," is a registered Limited Company with the Jersey Financial Services Commission ("JFSC") registration number 113248. Indigo Estates (Jersey) (2013) Limited is also registered with the Jersey Office of the Information Commissioner ("JOIC") as a Data Controller, registration number 18271.

We will comply with data protection law, the principles of which state that the personal information we hold about you must be:

  • Used lawfully, fairly, and in a transparent way.
  • Collected only for valid purposes that we have clearly explained to you and not used in any way incompatible with those purposes.
  • Relevant to the purposes we have told you about and limited only to those purposes.
  • Accurate and kept up to date.
  • Kept only as long as necessary for the purposes we collected.
  • Kept securely.

Indigo Estates is accountable to you and the authorities for demonstrating compliance with data protection laws.

The Data Protection Manager ("DPM")

We have appointed a Data Protection Manager (DPM) to oversee compliance with this Privacy Notice.

What information do we collect about you?

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). To explain this, we will list our different services and the additional information we collect or use:

What Special Category Data Do We Collect?

Indigo Estates does not collect special category data during usual business activities.

We do not collect any Special Categories of Personal Data about you. This includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data. Nor do we collect any information about criminal convictions and offences.

How We Will Use Information About You

We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:

  1. You have entered into a contract with us to provide you with a service; this would be when you engage us for a service and sign a contract of agreement.
  2. We need to comply with a Legal Obligation; an example of this would be when we have to comply with lawful authority to disclose information.
  3. Where it is necessary for our Legitimate Interests (or those of a third party), your interests and fundamental rights do not override those interests. An example is when we send you our newsletter or an update on our property listings.

We may also use your personal information in the following situations, which are likely to be rare:

  1. Where you have given your consent for us to contact you for a specific purpose; an example of this would be when you register with us to provide you with the service.
  2. In an emergency, it is in your Vital interest to share your information when we have it recorded. An example of this would be immediately informing the potential buyer about hazards in the property to ensure their safety.

Change of Purpose

We will only use your personal information for the purposes we collected it unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

If we need to use your personal information for an unrelated purpose, we will notify you and explain the legal basis for our use.

Data Sharing

We may occasionally pass your Personal Information to an organization outside of Indigo Estates exclusively to process on our behalf; these organizations are called Data Processors.

We require these parties to agree to process this information according to our instructions and requirements, which are consistent with this Privacy Notice.

We do not pass on information gained from your engagement with us without a clear legal basis. However, we may disclose your Personal Information to comply with legal obligations, regulations, or valid governmental requests.

The personal data we collect from you may be transferred to and stored at a destination outside the European Economic Area ("EEA"). It may also be processed by companies outside the EEA that work for either one of our service providers or us.

If we do this, we will ensure that your privacy rights are respected in accordance with this Policy and that your personal information is protected as laid down by the Data Protection (Jersey) Law 2018 ("DPJL").

Indigo Estates uses overseas web and IT providers. Details of what data is sent where and the safeguards in place are included in the Processor table above.

Data Security

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, altered, disclosed, or accessed unauthorized. In addition, we limit access to your personal information to colleagues, agents, contractors, and other third parties on a need-to-know basis. They will only process your personal information according to our strict instructions and are subject to a duty of confidentiality. Details of these measures may be obtained from our Data Protection Manager (DPM).

We have implemented procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required.

Data Retention

We will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including to satisfy any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider various factors, such as the amount, nature, and sensitivity of the data, potential risks, and applicable legal requirements. You can request our Data Retention Schedule from our DPM if required.

In some circumstances, we may anonymize your personal information so it can no longer be associated with you. In that case, we may use such information without further notice.

Rights of Access, Correction, Erasure, and Restriction

The personal information we hold about you must be accurate and current. Please keep us informed if your information changes during your relationship with us.

Under certain circumstances, by law, you have the right to:

  • Request access to your personal information (commonly known as a "data subject access request").
  • Request correction of the personal information that we hold about you.
  • Request erasure of your personal information.
  • Object to processing your personal information where we rely on a legitimate interest.
  • Request the restriction of processing of your personal information.
  • Request the transfer of your personal information to another party.

You will not have to pay a fee to access your personal information (or exercise any other rights). However, we may charge a reasonable fee if your request is unfounded or excessive.

How to Request Your Information

Use the Data Subject Access Request form available on our Cookie Banner. If you have questions about this process or your rights, contact our DPM.

We may need to verify your identity before responding to your request. We will respond within four weeks (or up to eight weeks in complex cases).

Right to Withdraw Consent

If you provided consent for specific processing, you have the right to withdraw it at any time. Contact our DPM to withdraw your consent.

Once we receive notification of withdrawal, we will no longer process your information for the original purpose unless another legitimate basis exists.

Changes to this Privacy Notice

We reserve the right to update this privacy notice. We will provide a new notice for substantial updates and may notify you in other ways from time to time.

Complaints

We want the chance to resolve any complaints you have about how we process your information. You have the right to complain to the Jersey Office of the Information Commissioner (JOIC) about how we have used your data.
